Terms of Use

These terms cover using this website. They do not govern any work we do for you. Paid engagements are governed by the agreement signed for that project, and where the two ever appeared to conflict, the signed agreement is the one that applies.

What this page covers, and what it does not

This page covers browsing mbgdesk.com and sending an enquiry through it. It does not set the terms of any project, retainer or support arrangement. Those live in the contract for that work, which sets out scope, exclusions, timelines, payment terms, ownership and the exit position.

Some website terms pages attempt to bind clients to conditions they never negotiated. We would rather not, partly because it is a poor way to treat people and partly because it does not survive contact with a signed agreement that says something different.

Using the site

You may read this site, quote from it with attribution, and link to it freely. We would rather you linked than copied, but a quotation with a credit is welcome and does not need permission.

What we ask you not to do is republish substantial parts of it as your own, scrape it at a volume that degrades it for other readers, or attempt to interfere with the service or gain access to systems behind it.

The content on this site

The words, structure and design here are ours, with one class of exception: platform, product and company names mentioned in the text belong to their respective owners, and appear only to describe what we work with. Naming a platform is not a claim of partnership, endorsement or certification, and this site claims none.

The guidance on these pages is written to be genuinely useful and it is general. It is not advice about your specific situation, and anything touching law, tax, accounting, medical practice or regulation is a matter for your own qualified adviser rather than for us.

Accuracy and availability

We keep this site accurate and correct things when we find them wrong. Platforms change, rules change and pages age, so we cannot promise that everything here is current at the moment you read it. Where something matters to a decision you are making, ask us and we will confirm it in writing.

We do not promise uninterrupted availability. The site is maintained and monitored, and it will occasionally be unavailable.

Enquiries you send us

Send only what you are comfortable sending through an ordinary web form. Do not send confidential material, credentials, or anything under a duty of confidentiality until a suitable agreement is in place. If a project needs that, tell us and we will arrange one first.

What you send is used to reply to you and for nothing else. The privacy policy sets out the detail.

Liability

Nothing in these terms limits liability where the law does not permit it to be limited. Subject to that, we are not liable for loss arising from reliance on general guidance published here rather than on advice given for your specific circumstances.

Liability in respect of paid work is dealt with in the agreement for that work, where it can be set against the actual scope and value rather than guessed at in advance on a website.

Governing law, and getting in touch

MBGDesk operates from offices in India, the United States, the United Kingdom and the United Arab Emirates. The governing law and forum for a client engagement are stated in that engagement's agreement, which is the appropriate place for it given that it differs by market.
